Se ordenó al Tribunal Superior del Distrito Judicial de Armenia, Sala de Decisión Penal, asumir el conocimiento de la solicitud de tutela presentada por el ciudadano de la referencia contra la Fiscalía Dieciocho Penal Militar y el Juzgado Noveno Penal Militar.
Por lo anterior, siguiendo el criterio de interpretación sostenido por la Corte Constitucional, no es posible aplicar en el presente caso, el inciso 1° del numeral 2° del Art. 1° del Decreto Reglamentario 1382 de 2000 por cuanto, si bien las autoridades penales militares administran justicia (Art. 116 de la C.P.), su competencia se encuentra restringida exclusivamente a lo prescrito por el Art. 221 de la Carta Política.
Además dichas autoridades no forman parte de la rama judicial del poder público.
